Vince believes that being up front about costs is the most crucial aspect of establishing a trusting relationship. A Last Will is an investment and a critical aspect of your financial plan. Vince will go over your options and discuss fees at your first appointment. All fees are exclusive of taxes and disbursements.
Powers of Attorney are an essential instrument for both short term and long term planning. Execute a Power of Attorney so that your named attorney can act on your behalf on matters of financial importance and in critical health situations.
Completing your Last Will is vital to your legacy and demonstrates a clear commitment to your family and loved ones. Having a Last Will means you value certainty, and your property will be distributed in accordance with your wishes when you pass away.
If you're married or in a common-law relationship, you may both retain Vince to draft Last Wills for you. This is usually less expensive and time consuming. However, these Last Wills need to set out identical testamentary plans that are the "mirror image" of each other.
Dual Wills may be appealing to you if you have a business interest, such as shares in a small corporation, that you would like to pass down to future generations through your Last Will. Typically, dual wills are utilized to separate those assets that do not necessarily require probate, such as shares, from those that do. In Ontario, estate administration tax is payable in connection with an application for probate, so the use of dual wills may reduce this tax.
In Ontario, the practice of commissioning is governed by the Commissioners for Taking Affidavits Act (the “Act”). A commissioner for taking affidavits is a person who is entitled to take affidavits and administer oaths, declarations, and affirmations in accordance with the Act. By virtue of being a qualified Ontario lawyer, Vince is a Commissioner. Vince is also a registered Notary and carries a notarial seal.
